This Agreement (“Agreement”) is entered into on the date of signing by and between Dr. Jo Abbott, Developer of Back Pain Systems™ App (“Developer”) and (“Founding Member”).
1. Purpose of Agreement
As a Founding Member, you are granted lifetime access to the Back Pain Systems™ App for personal use. Your participation in the 6-week challenge does not limit your continued personal use of the app beyond this period.
2. Grant of Access
The Developer grants the Founding Member non-transferable, lifetime access to the Back Pain Systems™ App for personal use only. This access includes all content, updates, and resources available within the app.
3. Personal Use Only
The Founding Member agrees to use the Back Pain Systems™ App strictly for personal, non-commercial purposes. Use of the app’s content for coaching, professional practice, or any other form of third-party instruction, whether for profit or non-profit, is strictly prohibited.
4. Restrictions on Content Sharing and Copying
The Founding Member agrees not to copy, distribute, share, or otherwise make available any part of the app’s content to any third party. This restriction includes, but is not limited to, sharing any written, video, audio, or visual content from the app with others, whether in person or electronically.
5. Intellectual Property Rights
The content within the Back Pain Systems™ App, including all exercises, coaching material, videos, graphics, and any other resources, is the exclusive property of the Developer. Unauthorised copying, sharing, or reproduction of any content violates the Developer’s intellectual property rights.
6. Consequences of Breach
If the Founding Member is found to have shared, copied, or distributed any content from the app in violation of this Agreement, the Developer reserves the right to take legal action, including but not limited to financial penalties and legal fees, to the fullest extent permitted by law.
7. Termination of Access
In the event of a breach of this Agreement, the Developer may revoke the Founding Member’s access to the Back Pain Systems™ App immediately, without notice or refund.
8. Liability Waiver
The Founding Member agrees to indemnify and hold harmless the Developer against any claims, damages, liabilities, or expenses (including legal fees) arising from any unauthorised use or distribution of the app’s content.
9. Acknowledgment
By signing this Agreement, the Founding Member acknowledges and agrees to abide by all terms and conditions stated herein and recognises that failure to do so may result in legal action.
